A television advert for a pre-pay Maestro card by Tuxedo Money Solution was deemed to be effective and not misleading on two counts by the Advertising Standard's Agency (ASA).
The advert, which highlighted ways in which the pre-pay card could be used included the claim that it could be activated instantly and featured on-screen text stating: "Terms, conditions and fees apply."
One viewer challenged the ad, suggesting that it was misleading because the fees were not explicitly spelled out and questioned whether the card could really be "activated instantly".
Neither of the complaints were upheld.
The ASA stated that the £9.99 fee to get the card, 2.95 per cent fee on purchases and 1.5 per cent fee on ATM withdrawals were common for pre-pay cards. It also pointed out that the clear terms and conditions could be found on the website and that the ad's on-screen text warned viewers that there were costs associated with the card.
While the complainant had been unable to activate his card instantly, in dismissing the complaint, the ASA noted that most applicants could do it and the on-screen text's mention of conditions was sufficient.
